When a legal person is guilty of an offence against this Act or the regulations, any director, employee or agent of such legal person who has prescribed or authorized the commission of such offence or assented thereto, or acquiesced or participated therein is deemed a party to such offence and is liable to the same penalty as that provided for the legal person, whether or not it has been prosecuted or found guilty.
